1. Provider and scope
These Terms govern use of the Don't Break Two mobile application and its optional paid and server-backed services. The provider is Tim Gabel, trading as HowtoHabit. Contact details are stated in the Impressum.
2. Purpose of the app
Don't Break Two is a habit-tracking and self-management tool focused on consistency, recovery after missed opportunities and gradual habit development. It does not provide medical, psychological, legal, financial or other professional advice.
3. Free use and accounts
Core local habit tracking can be used without creating an account. An account is required for server-backed paid functionality such as Premium entitlement verification, purchase restoration and AI Coach. Signing in does not by itself replace or erase locally stored habit data.
4. Paid products and billing
Paid products may include a non-consumable Premium unlock and an auto-renewing Coach subscription. The exact price, billing period and product description shown by the applicable app store at the time of purchase are authoritative. Payment processing, renewal, cancellation and store refunds are handled by Apple App Store or Google Play under their applicable terms. Purchases may require secure server-side verification before an entitlement is enabled.
5. Auto-renewing Coach subscription
Where Coach is offered as an auto-renewing subscription, it renews according to the billing period displayed by the store unless cancelled through the user's App Store or Google Play account within the store's applicable cancellation rules. Removing the app or deleting a Don't Break Two account does not itself cancel an app-store subscription.
6. AI Coach
Coach responses are generated using an external AI provider through the Don't Break Two backend. Relevant habit context and analytics may be transmitted to generate a response as described in the Privacy Policy. AI output may be incomplete, inaccurate or unsuitable for a particular situation. Coach must not be used for emergencies, diagnosis, treatment decisions or other high-stakes professional decisions.
7. Trajectory evaluation and machine learning
Premium may evaluate whether a habit appears to be building, stabilising, recovering, eroding, overreaching or otherwise changing direction. These trajectory labels are decision-support signals based on recorded behavior and product heuristics; they are not guarantees, diagnoses or scientifically calibrated probabilities of future behavior.
Don't Break Two may improve a shared trajectory model using bounded numerical learning signals derived on the device from past execution patterns. The learning system is designed so that no habit names, target text, free text, account identifier, habit identifier, exact event history or per-user training history is retained in the machine-learning model.
8. User responsibility
You are responsible for information you enter and for deciding whether a habit, schedule or suggested action is appropriate for you. Do not submit unlawful material, third-party confidential information you are not permitted to process, or content that infringes the rights of others.
9. Availability, updates and changes
The app and individual features may be corrected, improved, changed, temporarily unavailable or discontinued where reasonably necessary for security, legal, operational or product reasons. Local habit tracking is designed to remain independent of optional backend services where technically possible.
10. Accounts and termination
You may stop using the app at any time. Registered users may sign out and may delete their server account through the app where available. Account deletion does not automatically delete local app data from every device and does not cancel an app-store subscription. Local data can also be removed by deleting app data or uninstalling the app, subject to platform behavior.
11. Liability
Mandatory statutory liability remains unaffected, including liability for intent, gross negligence, injury to life, body or health and liability under mandatory product-liability law. Where liability for ordinary negligence may lawfully be limited, liability is limited to foreseeable damage resulting from breach of essential contractual obligations.
12. Consumer rights
Nothing in these Terms limits mandatory consumer-protection rights. Statutory rights and any rights provided directly by Apple or Google remain unaffected.
13. Applicable law
German law applies where legally permissible. Mandatory consumer-protection provisions of the country in which a consumer has their habitual residence remain unaffected.
